What are Kinder Eggs?
Kinder Eggs are hand-sized milk chocolate eggs, lined with a milky white chocolate cream liner and carry a small toy surprise inside its hollow shell. The hallow chocolate shell is fused together as it hides its toy surprise inside. The toy surprise can be one of 80,000 different toy surprises from various themes, some even hand-painted toys.

Kinder Eggs - Guilty or Not Guilty?
They sound innocent enough - What makes them Illegal? The 1938 Federal Food, Drug and Cosmetic Act has a section that basically says you can't sell a product with an EMBEDDED non-nutritive product inside Candy unless the non-nutritive product serves a purpose.

A Lollipop stick serves a purpose of holding the candy together, so lollipops are not illegal.
A cracker-jack toy is not EMBEDDED inside the candy. Instead, the toy is loosely thrown inside the box. So Cracker Jacks are not illegal.
Unwrapped, the Kinder Egg looks like a solid chocolate egg, with no sign of a candy hiding inside. The FDA feels that these kinder eggs are dangerous to kids and pose a choking hazard.
Editors Note:
When I did my research for this article, I didn't know that I would fall in love with the creative toys inside the Kinder Surprise Eggs! These toys are about the size of a quarter and can be so expressive, that they're addicting to look at!
